Alexis Payne

As a partner at Partridge & Partners, Alexis Payne has a unique and broad practice that encompasses intellectual property, advertising, privacy, publicity, and litigation. Her extensive skill set enables her to provide cutting-edge, comprehensive services to an extensive client base for a wide array of matters, including:

  • Trademark and copyright, including clearance, registration, prosecution, litigation, and domain name disputes;
  • Website privacy policy/terms of use, company-wide audits, and best practices counseling;
  • Review and clearance of advertising claim substantiation and representation in competitive advertising claims in arbitral and judicial forums;
  • All elements of developing and running domestic and international sweepstakes, contests, and other promotional offerings;
  • Domestic and international privacy counseling, including company-wide audits addressing practices of retaining and transferring personally identifying information; and
  • General commercial litigation, in state and federal courts and arbitral bodies, including the National Advertising Division (NAD), the National Advertising Review Board (NARB), the National Arbitration Forum (NAF), and the World Intellectual Property Organization (WIPO).

When asked what her area of specialty is, Alexis somewhat jokingly responds "do you have a few minutes?" This is because her practice encompasses not only IP, but advertising, privacy and social media as well. And Alexis's roots in litigation and evolutionary foray into other practice areas enables Alexis to assist clients with what were, once upon a time, isolated silos of legal expertise.

If a client is considering a trademark application, Alexis can advise clients on trademark prosecution and litigation matters. But her experience doesn't end there. Alexis's advertising experience also enables her to advise clients on the legal implications of using a trademark in advertising and promotional contexts. Alexis is astute at identifying intellectual property, privacy, and publicity issues that arise in social media promotions. Alexis also has significant experience assisting clients with advertising substantiation and comparative advertising disputes. In doing so, she's garnered unique experience, such as learning the intricacies of toilet flushing, truck, aluminum foil, and windshield wiper efficiency.

As a "lapsed" artist and mother of two young daughters, Alexis gets her artistic "fix" through art projects with her children and her representation of pro bono clients through the Lawyers for the Creative Arts (LCA). Notably, Alexis assisted Berna Huebner, on behalf of her renowned mother and artist, Hilda (Hilgos) Gorenstein, and the non-profit Hilgos Foundation. Alexis advised on international intellectual property matters relating to the development of the internationally distributed and widely-acclaimed documentary, "I Remember Better When I Paint." The documentary highlights Mrs. Gorenstein's artistic achievements and the benefits art provides to Alzheimer's patients. Alexis's involvement with the development of the documentary was highlighted during the 2015 Lawyers for the Creative Arts annual benefit. She continues to serve other LCA clients.
